I/We (individually and collectively hereafter known as “I”) hereby authorize Numark Services to perform Reconstruction service at my property at the above address. I understand that it takes time to determine the extent of the scope of work given the nature of this loss; however, I am consenting to Numark Services’ professional judgment on the scope of work required given the nature of the loss. I authorize and direct the Insurance Company listed above to pay Numark Services directly for the work covered by insurance. If for any reason the payment should come to me, I hereby agree to pay Numark Services immediately up on receipt of the payment from the insurance company.
I understand that Numark Services is working for me and not the insurance company, adjuster and/or agent. It is fully understood that I am personally responsible for any and all work performed by Numark Services regardless of the amounts paid by insurance, or any deductible, depreciation or any other charges or costs not covered by insurance. I agree to pay Numark Services directly for any amount not covered by insurance.
The liability of Numark Services is expressly limited to the total amount of the services authorized herein and in no event shall Numark Services, its agents or assigns, be liable for consequential damages of any kind. Numark Services is responsible for only the personal property listed on an inventory signed by me and by a Numark Services representative.
I understand that I am liable to Numark Services for all costs associated with collection efforts made by Numark Services to compel payment from me. In the event of any litigation between the parties under this agreement, the prevailing party shall be entitled to reasonable attorney’s fees and cost at all trial and appellate levels.
